the dti provides protection for SACU industry through the increase in the level of anti-dumping or countervailing duties in cases where the exporter or the importer absorbs the anti-dumping or countervailing duty, i.e. where there is no or insufficient price movement following the imposition of such duties.
The process involves the following steps:
- Receive application from SACU industry
- Assessment of completeness and correctness
- Acceptance of properly documented petition
- Notify foreign government
- Verify domestic industry's information
- Merit assessment by BTT
- Prepare Government Gazette publication
- Initiated in Government Gazette
- Importers and exporters receive opportunity to respond
- Verification of importers' and exporters' information
- Preliminary determination by BTT
- Implementation by SARS of provisional payments
- Parties receive opportunity to comment on preliminary decision
- Essential facts letter sent to parties
- Final determination by BTT
- Compile final report
- Recommendation to Minister of Trade and Industry
- Implementation by SARS
- Implementation by SARS of anti-dumping duties
