the dti provides this offering in order to determine whether any anti-dumping or countervailing duty that has been in place for five years needs to be continued, i.e. whether there will be a continuation or recurrence of injurious dumping or injurious subsidised exports if the duty were to be removed. The purpose of the offering is to provide protection for the SACU industry against continuation or recurrence of dumping and material injury.
The process involves the following steps:
- Publication in the Government Gazette by BTT of intention to review
- SACU manufacturers request review
- SACU manufacturers submit substantiating information
- Merit assessment by BTT to decide whether to review or not
- Notify foreign government
- Review proceedings initiated through notice in Government Gazette
- Verification of SACU manufacturer's information
- Send questionnaires to importers and exporters
- Verification of importer's and exporter's information
- Submission of all information to BTT for decision
- Letters containing essential elements to all interested parties for comment
- Final determination by BTT
- Compile final report
- Recommendation to Minister
- Implementation by SARS
The turnaround time for this offering is 9 to 12 months.
